Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern your use of Casework (“the Service”), a web application operated by Aesthetic Ag Ltd (“we”, “us”, “our”), a company registered in England and Wales (Company Number 12626354), with its registered office at 113 Union Street, Oldham, United Kingdom, OL1 1RU.

By creating an account and using the Service, you (“you”, “the User”) agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

3. Account Registration

3.1. You must provide accurate and complete information when creating an Account.

3.2. You are responsible for maintaining the security of your Account credentials and for all activity that occurs under your Account.

3.3. You must be at least 18 years of age to create an Account.

3.4. One Account per individual. You may not create multiple Accounts.

3.5. You must notify us immediately at help@case-work.app if you become aware of any unauthorised use of your Account.

4. Service Description

4.1. Casework provides dental marketing tools including a Photo Composer for creating before-and-after dental case presentations, and a Smile Reveal tool for creating transformation reveal videos.

4.2. All image processing is performed locally on your device. Patient photographs and dental images are never uploaded to, transmitted to, or stored on Casework servers. Images remain entirely within your web browser during use and are saved directly to your device on export.

4.3. The only data stored on our servers is your Account information (name, email), subscription status, usage metrics (e.g. video export count), and preference data. See our Privacy Policy for full details.

4.4. Logos uploaded for watermarking purposes are stored locally on your device using your browser’s IndexedDB storage. If you explicitly enable cloud backup, saved logos are also stored in your private Casework account so they can be restored when you sign in on another browser or device.

4.5. Template configurations (layout settings, text overlays, logo placement, and related design settings) are stored locally on your device using your browser’s IndexedDB storage. If you explicitly enable cloud backup, these template settings are also stored in your private Casework account for cross-device restore. Patient photographs and dental images are not included in template backup.

5. Subscription Plans and Billing

5.1. The Service offers two tiers:

5.2. The Pro Plan is billed in advance on a recurring basis (monthly or annually, depending on your selection).

5.3. Payments are processed securely by Stripe. Casework does not store your payment card details.

5.4. Prices are in British Pounds Sterling (GBP) and are inclusive of VAT where applicable.

5.5. We reserve the right to change subscription pricing with at least 30 days’ notice. Price changes will take effect at the start of your next billing cycle.

5.6. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

6. Free Trial

6.1. New users receive a 7-day free trial of the Pro Plan (14 days if referred by an existing user). No credit card is required. The trial includes unlimited editing and previewing, full logo, template, layout, and watermark-free access, capped at 20 photo exports and 5 video exports.

6.2. At the end of the trial period, your Account will automatically revert to the Free Plan unless you subscribe to the Pro Plan.

6.3. Templates saved during the trial period will be locked (not deleted) on reversion to the Free Plan. They will become accessible again if you subscribe to the Pro Plan.

6.4. Each user is entitled to one free trial only.

7. Cancellation and Refunds

7.1. Cooling-off period: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Pro Plan subscription within 14 days of your initial subscription purchase for a full refund. To exercise this right, contact us at help@case-work.app.

7.2. Cancellation after cooling-off: You may cancel your Pro Plan subscription at any time through your account settings (Stripe Customer Portal) or by contacting us at help@case-work.app.

7.3. Upon cancellation, your Pro Plan access will continue until the end of your current billing period. No refunds will be issued for the remainder of the billing period.

7.4. On cancellation, your Account will revert to the Free Plan. Saved templates will be locked (not deleted) and will become accessible again if you resubscribe.

8. User Responsibilities and Healthcare Data

8.1. You are the data controller. If you use the Service to process Patient Images, you (or the dental practice you represent) are the sole data controller for those images under UK GDPR. Casework does not access, process, store, or transmit Patient Images.

8.2. You are solely responsible for:

8.3. Casework accepts no liability for your use of Patient Images or your compliance with healthcare data protection requirements.

8.4. You must not use the Service for any purpose that is unlawful or prohibited by these Terms.

9. Intellectual Property

9.1. Our IP: Casework, its software, design, branding, logos, and all associated intellectual property are owned by Aesthetic Ag Ltd. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.

9.2. Your content: You retain full ownership of all Content you create or upload using the Service, including photos, logos, composed images, and exported videos. We claim no ownership or licence over your Content.

9.3. Because your Content is processed locally on your device and is never transmitted to our servers, we have no access to it and require no licence to it.

10. Acceptable Use

You must not:

10.1. Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

10.2. Attempt to gain unauthorised access to the Service, its servers, or any associated systems.

10.3. Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Service.

10.4. Use automated scripts, bots, or other tools to access or interact with the Service.

10.5. Interfere with or disrupt the integrity or performance of the Service.

10.6. Share your Account credentials with any third party or allow others to use your Account.

10.7. Resell, sublicense, or commercially exploit the Service without our prior written consent.

11. Limitation of Liability

11.1. To the maximum extent permitted by law, Casework’s total aggregate liability to you for any claims arising out of or related to these Terms or your use of the Service shall not exceed the total fees paid by you to Casework in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.

11.2. To the maximum extent permitted by law, Casework shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, regardless of whether we were advised of the possibility of such damages.

11.3. Nothing in these Terms excludes or limits our liability for:

11.4. The Service is provided for use as a marketing tool. It is not a medical device and must not be relied upon for clinical decision-making.

12. Service Availability and Modifications

12.1. The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free access.

12.2. We may modify, update, or discontinue features of the Service at any time. Where practicable, we will provide reasonable notice of material changes.

12.3. We may perform scheduled maintenance that temporarily affects availability. We will endeavour to provide advance notice of planned downtime.

13. Termination

13.1. You may terminate your Account at any time by contacting us at help@case-work.app.

13.2. We may suspend or terminate your Account immediately if you breach these Terms, use the Service unlawfully, or engage in conduct that we reasonably consider harmful to other users or our business.

13.3. On termination, your right to use the Service ceases immediately. Data associated with your Account will be handled in accordance with our Privacy Policy.

14. Changes to These Terms

14.1. We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notification at least 30 days before the changes take effect.

14.2. Material changes may require you to re-accept the updated Terms before continuing to use the Service.

14.3. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

15. Governing Law and Disputes

15.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

15.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3. Nothing in these Terms affects your statutory rights as a consumer.
